Abstract
Background. In the context of modern metamodern society, post-truth and information illusions, protection of historical truth requires additional efforts. In this regard, the aim of studying the sources and forms of old Slavic law in the Middle Ages is not only to eliminate the gaps in this area of legal Slavic studies, but also to formulate a scientific unbiased idea of the patterns of forming the legal systems of the Slavic peoples during the early genesis of their statehood. Materials and methods. To achieve this aim, comparative legal methodology is employed to analyze the extensive source material consisting of legal customs, international and domestic treaties, regulations, judicial precedents, specific charters and informal codification collections of law of the Western (Poles and Czechs), southern (Croats, Slovenes, Serbs and Bulgarians) and Eastern Slavs (Rus) in the Middle Ages. Results. The theoretical problem of the relationship between the categories “sources” and “forms” of law is studied. The study proves that these definitions do not coincide and have different content. The analysis shows that the old Slavic states used various forms of law that corresponded to the needs of feudal society. Conclusions. The study of the sources and forms of old Slavic law enables identifying two important patterns: firstly, among the sources of law, government bodies opposing the communal self-government of the people gradually began to dominate, and secondly, the dominant place among the sources of law was occupied by normative legal acts adopted by the rulers individually or by the collegial bodies, such as popular assembly (or veche), convocation (or sobor), representative assembly (or sejm), etc.
